WASHINGTON — Investigators have advised that prosecutors not charge a U.S. Capitol police officer in the shooting death of a rioter, The Wall Street Journal reported Monday. The officer shot Ashli Babbitt inside the U.S. Capitol on Jan. 6 when pro-Trump rioters stormed the building.
According to CNN, Justice Department officials could make a final decision in the coming days. The shooting remains under investigation by the DC Metropolitan Police, the US Attorney’s Office in Washington, DC, and civil rights prosecutors, a routine process for shootings involving the Capitol Police.
Video shows Babbitt was trying to breach a doorway with a crowd of other rioters when she was shot. The officer who shot her was placed on administrative leave, according to WSJ.
